Terms and conditions of
the СlubMiles Program

The “ClubMiles” Program is a program developed for Holders and Users of Diners Club Cards, in which they can redeem collected Miles to the rewards and additionally are rewarded for making debit transactions with Diners Club cards on the ClubMiles Program Platform.

The Operator and Organiser of the Program is ClubMiles Sp. z o.o., 18 Jana Dantyszka street, Warsaw, 02-054, Poland, KRS 0000638598.

These Regulations constitute the basis for the ClubMilles Program and define the rights and obligations of its Participants.

1. Definitions

Customer (Card Holder/User) – a person who:

  • is 18 years or over;
  • entered into a suitable agreement with DCP or another Diners Club card issuer in the territory of Poland and uses a Diners Club International branded Diners Club Traveler, Diners Club PREMIUM VINTAGE or Diners Club Classic Card legally;
  • is registered in the “ClubMiles” Program.

Card – Diners Club Traveler, Diners Club Classic or Diners Club PREMIUM VINTAGE payment card (payment card issued by DCP or another Diners Club card issued in the territory of Poland) issued to a Card Holder/User on the basis of an agreement concluded between DCP and the Card Holder/User or between another Diners Club card issuer in the territory of Poland and the Card Holder/User.

Rewards: flight tickets and/or hotel bookings for which the Customer may exchange ClubMiles Miles they collected on their Account in the ClubMiles Program.

Diners Club Loyalty Program (hereinafter “DC Rewards Program”) – a program managed by DCP in which DC Card Holders/Users collect points for transactions they make with their cards.

ClubMiles Program (hereinafter “ClubMiles Program”) –loyalty program rewarding the participants for payments made with the Card, enabling collecting ClubMiles Miles and redeeming them for Rewards.

ClubMiles Miles (hereinafter “Miles”) – basic accounting units in the ClubMiles Program that are recorded on the ClubMiles Account.

ClubMiles Premium Miles (hereinafter “Premium Miles”) – basic accounting units in the ClubMiles Program deriving from the DC Points exchange.

ClubMiles Statutory Miles (hereinafter “Statutory Miles”) – basic accounting units in the ClubMiles Program deriving from air tickets/hotel booking purchase transactions made with the Card on the ClubMiles Platform.

DC Loyalty Program Organiser – Diners Club Polska Sp. z o.o. (hereinafter “ DCP”) Senatorska str. 12, 00-082 Warsaw.

ClubMiles Program Organiser (hereinafter “the Program Organiser”) – ClubMiles Sp. z o.o., 18 Jana Dantyszka street, Warsaw, 02-054, Poland, KRS0000638598.

DC Points - conditional points allocated by DCP to Card Holders/Users for making debit transactions with the Card (for purchasing goods/work/services/cash withdrawals with DC Cards). After the transfer to the ClubMiles Account DC points become ClubMiles Premium Miles.

ClubMiles Program Platform – shall mean a website managing the Program Organiser’s online store where Customers may purchase flight tickets and/or book hotels using DC Cards or their accumulated ClubMiles Miles, or redeem the collected Miles for Rewards.

Registration – Registration of the Customer to the ClubMiles Program by DCP on the basis of voluntary consent of the Customer expressed in the Card Agreement in the case of Diners Club TRAVELER or Diners Club PREMIUM VINTAGE Card or in the case of Diners Club Classic Card in the Application for Participation in the DC Loyalty Program as well as the agreement to entrust personal data processing in order to register to the ClubMiles Program concluded between DCP and the Program Organiser.

The ClubMiles Program database processed by the Program Organiser includes personal data of the Customers and is held by the Program Organiser, is the basis of personal data within the meaning of Polish Act On Personal Data Protection and the Program Organiser shall be considered the owner and administrator of such personal database and terms and conditions of the Program. Responsibility for the legitimacy of the processing of personal data received from the Customers and for registration of the personal data file shall be conferred on the Program Organiser. The Customer is entitled to view and correct his/her personal data.

DC Loyalty Program Account – an account maintained by DCP where the number of DC points for the specific Customer is recorded, according to the DC Loyalty Program Terms and Conditions.

ClubMiles Account – an account created on the platform located on the official website of the Program at www.ClubMiles.pl, which enables the Customer to obtain information about the Miles status, to exchange all or some Miles for Rewards.

Link ID – a unique ID and link that a Customer receives upon a successful registration to the ClubMiles program at an email address given in the Card Agreement. Within 72 hours from a successful registration a Customer shall log into his/her ClubMiles Account for the first time, using the link ID and set his/her own password. Login and password enable access to the Customer ClubMiles Account and redeeming the collected Miles.

2. General provisions

2.1. A person registered in the Program shall be deemed to have been familiarized with and agreed to its terms and conditions.

2.2. Company ClubMiles Sp. z o.o. (the Program Organiser) reserves the right to change (in whole or in part) or terminate the Program at starting with at least a 6 months notice. Changes may concern the rules of the Program, conditions of participation, number of Miles required for exchange, period of validity of the Miles, etc. These Regulations define the terms of participation in the ClubMiles Program and the requirements to its participants and other parties.

2.3. Participation in the Program is individual, legal entities are not allowed to participate in the Program. Only individuals aged 18 or older who have a valid Card may participate in the Program.

2.4. Each participant is entitled to only one Account.

3. Conditions of participation in the ClubMiles Program

3.1. Only an individual, who gave his/her prior consent to processing of personal data in the Registration process through DCP in the Card Agreement or in the case of the Diners Club Classic card in the Application for Participation in the DC Loyalty Program, may be the Participant (Customer) of the Program. Processing of personal data shall mean "any action or a combination of actions carried out in the information system of the Program related to collection, registration, accumulation, storage, adaptation, change, update, use and dissemination, removal of information about an individual."

3.2. DCP on behalf of the Customer registers him/her in the Program on www.clubmiles.pl and provides to the Program Operator his/her Unique ID (the Unique identifier). Upon successful registration, the Customer receives a Unique ID at an email address given in the Card Agreement. The Customer shall give his/her consent for the ClubMiles Account number (Unique ID) to be transmitted to the program Organiser by DCP through a secure protocol.

3.3. Participation in the ClubMiles Program shall not require acquiring any specific rights.

3.4.The Program Organiser may terminate Program participation of a Customer with immediate effect for justified reasons.

For justified reasons deemed to:

    • a serious violation of these Regulations - in particular,
    • sale, exchange or other type of transfer of miles to a third party,
    • unauthorized use of miles,
    • violation of the rules governing the use of the ticket - prizes,
    • unauthorized transfer of award documents and trafficking (eg. tickets - prizes),
    • false data necessary to provide the services specified in this Program,
    • the amendment or repeal of generally applicable laws of the Republic of Polish affecting the activities of the Program Organizer.

3.5. The Program Organiser sends a Program participation termination notice to the Customer, to the e-mail address kept in the Customer’s Account panel.

3.6. In the event of termination of Customer participation in accordance with item 3.4 above, Miles collected by the Customer shall be cancelled within 48 hours from participation termination and the Customers’s ClubMiles Account is blocked.

3.7. In the event of termination of the Agreement by the Program Organiser in accordance with item 3.4 above, the Program Organizer immediately informs DCP of this fact and DCP deactivates the Customer’s DC Loyalty Program Account and disables Customer to transfer collected DC points into his/her ClubMiles Account.

3.8. In the event of termination of ClubMiles Program participation resulting from Customer’s resignation from the Card, the Miles expire after 3 months from the notice period. The Customer authorizes DCP to inform the Program’s Organizer about the Card’s contract termination. From the moment of the effective resignation from the Card the option of split tender will not be available anymore. Only full coverage of Services with Miles will be available during those 3 months.

3.9. The Program Organiser provides posting of the current version of the Terms/Regulations of the Program on its official website www.ClubMiles.pl and informs the Participant via ClubMiles Program Platform and Customer Account panel of the following:

      • terms of the Program;
      • balance of the ClubMiles Account;
      • current promotional offers as to the possibility to redeem Miles.

3.10. The Customer may obtain details of the accrued and convertible Miles and balance of the ClubMiles Account at www.ClubMiles.pl by logging into his/her Account by providing the password selected in the Registration process and the Login received.

4. Crediting the ClubMiles Miles

4.1. The basic accounting units in the ClubMiles Program are ClubMiles Miles.

4.2. ClubMiles Miles are credited to the Customer’s Account only when the Customer is a registered ClubMiles Program participant.

4.3. DC Points are accrued for purchases made in a sales and service network in Poland and abroad including on the Internet, and paid by the Card and by cash withdrawals according to DC Loyalty Program Terms and Conditions. DC Points are converted into ClubMiles Premium Miles at the following rates: 1 DC point = 1 ClubMiles Premium Miles. Transactions made by the Customer with the Card on the official website of the Program Organiser shall be rewarded with ClubMiles Statutory Miles in accordance with the rules defined in items 4.6 and 4.7 below.

4.4. Welcome DC Points will be awarded to the Customer after the first transaction with the Card will be done according to the DC Loyalty Program Terms and Conditions..

4.5. DC Points accrued on the DC Loyalty Program Account in accordance with items 4.3 and 4.4 above, shall be notified by Diners Club Polska to the ClubMiles Program Organiser once a month by the 5th day of every month.

4.6. ClubMiles Miles are accrued for the purchase of flight tickets at www.ClubMiles.pl at the rate of 1 Statutory Mile per PLN 3. Each valid Transaction shall be divided by 3. The result shall be the total number of ClubMiles Miles rounded down to a full Mile, which is awarded to the Customer’ ClubMiles Account.

ClubMiles Miles are accrued for the purchase of flight tickets at low cost airlines at the rate of 1 Statutory Miles per PLN 2. The result shall be the total number of ClubMiles Miles rounded down to a full Mile, which is awarded to the Customer’ ClubMiles Account.

All flight tickets purchased for low cost airlines at clubmiles.pl are non exchangeable and non-refundable.

To the low cost airlines in the meaning of the ClubMiles Loyalty Program are counted: WizzAir, RyanAir, EasyJet, Vueling, Eurowings, Norwegian, Volotea.

4.7. ClubMiles Miles are accrued for hotel reservation at www.ClubMiles.pl at the rate of 1 Statutory Mile per PLN 1 spent.

4.8. During the advertising campaigns, special events and proposals, additional Statutory Miles may be accrued.

4.9. Miles are not awarded for returned goods, air tickets and hotel reservations. In case of returned goods (air tickets, hotels reservations) the Program Organizer is entitled to withdraw the exact number of Miles that was previously awarded for this purchase.

4.10. Statutory Miles collected in accordance with item 4.6 are credited within 72 hours after the transaction.

4.11. Statutory Miles collected in accordance with item 4.7 are credited within 72 hours after the check-out from the hotel.

4.12. In case of errors (incorrectly accrued/withdrawn Miles, etc. in accordance with items 4.6 and 4.7), the Program Organiser shall reserve the right to make the necessary adjustments to the balance of the Participant.

5. Use of the Miles

5.1. The ClubMiles Miles are not and may not be a means of payment, any type of currency or security.

5.2. Accumulated Miles may not be converted to money equivalent and paid to the Customer in cash.

5.3. Every Customer has a ClubMiles Account for recording collected Miles.

5.4. The Miles from the Account of one Customer may not be combined with Miles of other Customers or converted to miles in another program.

5.5. If the Customer has a sufficient number of the Miles on his/her ClubMiles Account, he/she may file an application to exchange the accumulated Miles for flight tickets and/or hotel reservations at www.ClubMiles.pl or cover them partially with the Card and partially with Miles.

5.6. Accumulated Miles may be exchanged or used to purchase all flight tickets and hotel bookings available at the Program Organiser’s website at www.ClubMiles.pl. Each Mile can be redeemed for the value of 0,03 PLN net.

5.7. The terms of order and delivery of flight tickets and confirmation of hotel reservation (payment).

Ordering of flight tickets and confirmation of hotel reservations (payment) should be performed at the Program Organiser’s website www.ClubMiles.pl upon logging to the Customer’s panel (Personal Account, by entering password and Login). Each transaction of payment with the Miles is subject to strong authentication, which means that it requires:

a) The Customer data entered in the log-in to the ClubMiles Account;

b) One-time transaction confirmation code generated by the Program Organiser and sent to the Customer’s mobile phone number given in the Card Agreement and that is given in the registration process.

5.8. The Customer is obliged to update his/her mobile phone number on the ClubMiles Platform via special feedback forms by sending such information to the DCP and e-mail address via customer support line of DC Poland (phone: +48 22 826 07 66, email: customer.services@dinersclub.pl). DCP immediately upon receipt of such a notification, confirms such changes with the Customer and updates this information in the Platform back office panel.

5.9. Delivery of flight tickets and confirmation of hotel reservation (payment) should be performed to the e-mail of the Customer provided during registration in the ClubMiles Program.

5.10. Flight tickets and hotel reservations received by the Customer in exchange for the Miles, or in exchange for Miles and Cash (split tender), shall be non exchangeable and non-refundable.

5.11. Rewards may not be sold or exchanged, or transferred to third parties, except for those, for whom a given service has been bought and whose data appear on the air ticket/hotel booking confirmation. It is also forbidden to mediate in the sales or purchase of documents related to rewards, and to illegally purchase or use such documents.

6. Validity of ClubMiles Miles

6.1. The Miles shall be valid for 24 months from the date of their crediting to the Customer’s individual Account.

The Customer shall be notified with due advance of the number of Miles and the date of their possible expiry to the e-mail address available on his ClubMiles Account panel.

7. Termination of ClubMiles Program

The Program Organiser shall reserve the right to terminate the ClubMiles Program at any time. In such an event the miles collected on the Customer Loyalty Program Account remain valid until the effective date of termination of the Loyalty Program. The same rules shall apply in a situation where Diners Club Loyalty Program is replaced by a different Program. In such a case, the Customer shall have the right to terminate his/her participation in the Program in accordance with item 3.8 .The Customer shall also have such a right in the event the Program Organiser is changed.

8. Liability

In the event of direct losses incurred by the Customer in relation to his/her participation in the ClubMiles Program caused by the Program Organiser, the Program Organiser shall be completely liable for redressing the loss, no potential income shall be readdressed. The Program Organizer shall not be held liable for the improper fulfillment of the Third Parties’ obligations (such as Airlines, Hotels and others).

9. Rules for the submission and consideration of complaints

9.1. Any claims concerning the Customer’s participation in the ClubMiles Program should be reported in written to the Program’s Organizer e-mail address available on www.ClubMiles.pl

9.2. The claim should include at least:

      • name and the surname of the Customer;
      • number of Customer’s Account in the ClubMiles Program;
      • description of the claim.

9.3. Claims will be processed by the Program Organizer immediately, but not longer than 30 days after it’s receipt.

10. Amendments to the Clubmiles Program

The Program Organiser shall reserve the right to amend, anytime, the Terms of participation in the Program, the Rewards and Reward lists if such amendments are deemed necessary. Customers shall not make any claims against the Program Organiser for losses caused by amendments to participation Terms if such amendments were required by the law.

Any amendments to the Terms of participation shall be made in writing and delivered to the Customer in the electronic form to the Customer’s email address indicated during the Registration to the ClubMiles Program not later than 2 months before become valid and those amendments should be published on the www.ClubMiles.pl Such amendments shall be deemed accepted if the Customer does not express his/her objection within 2 months from the receipt of the relevant notification.

If the Customer fails to accept changes to Terms of participation, his/her participation in the Program may be terminated in accordance with items 3.4, 3.5 and 3.6 above.

The Program Organiser is entitled to communicate with the Customer using all communication channels indicated in the process of the Customer’s registration to the Program.

11. Governing law and jurisdiction

The Terms of participation in the ClubMiles Program shall be governed by the Polish law.
